1. Acceptance of Terms
By accessing or using BuilderCloud's platform and services ("Service") at buildercloud.in, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all these Terms, you may not use the Service.
2. Description of Service
BuilderCloud is a cloud-based property inventory and booking platform for real estate builders, developers, sales teams, and brokers. The Service enables users to manage property listings, bookings, team collaboration, and broker access through web and mobile applications.
3. User Accounts
To use the Service, you must register and create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorized access. We reserve the right to terminate accounts that violate these Terms.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with all applicable Indian laws and regulations. You may not use the Service to store or transmit infringing, libelous, or illegal content; interfere with the platform's operation; attempt unauthorized access; or engage in any activity that could harm other users or BuilderCloud.
5. Intellectual Property
The Service, including all software, design, text, graphics, and content, is owned by BuilderCloud and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your business operations. You retain ownership of data and content you upload to the platform.
6. Payment and Billing
Access to premium features requires a paid subscription. Pricing is as agreed during the sales process. Subscriptions renew automatically unless cancelled. You are responsible for maintaining accurate billing information. Failure to pay may result in suspension of your account.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You retain ownership of your data uploaded to the platform. By using the Service, you grant BuilderCloud a license to host, process, and transmit your data as necessary to provide the Service.
8. Service Availability
We aim to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. We are not liable for any losses resulting from Service downtime or interruptions.
9. Limitation of Liability
To the maximum extent permitted by law, BuilderCloud shall not be liable for any indirect, incidental, special, or consequential damages, including loss of revenue or data, arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months prior to the claim.
10. Termination
Either party may terminate the service relationship with notice as per the agreed subscription terms. Upon termination, your access to the platform will cease. We will retain your data for 90 days post-termination for download, after which it will be deleted.
11. Governing Law
These Terms are governed by the laws of India. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of India.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be communicated via email or in-platform notification.
